Default What pay am I entitled to?

Agency workers:

'Strictly speaking, a supply teacher employed through a teacher employment agency is not an employee of the school or of the LEA. Such teachers are not entitled to the rates of pay set out in the School Teachers' Pay and Conditions Act. Nevertheless, agency teachers are still expected to fulfil the core duties and responsibilities set out for a teacher under the direction of the head teacher...'

Direct through the school or LEA:

'Teachers with short-term contracts with a school or LEA are, for most purposes, treated and expected to act as regular teachers. They are covered by the School Teachers' Pay and Conditions Document and are given a salary assessment in the normal way.'

'Supply teachers need to agree their working-time arrangements with their employers. There is no statutory provision concerning the length of their working day but the Secretary of State considers it should be 6.5 hours of working time (including an allowance for duties other than teaching pupils). Such teachers should always be offered the opportunity of being involved in other duties, as well as teaching pupils, and then be paid at the full daily rate.'

service.

Hi ****,

Thanks for taking the time to look at this. I think the main point really is that as a supply teacher, not working through an agency etc., I seem to be entitled to a salary assessed 'in the normal way' under the School Teachers' Pay and Conditions Document, which is 1/195th or 6.48 hours per day. It makes sense, and it's what I always assumed I was getting, which I why I started looking at my payslips as they were often a

hours short on what I'd recorded. If I worked everyday in School X, and others I presume, I'd not get a full years' wage.

This is a link to the page saying that supply teachers are treated under this document as regular teachers:

ies of my timesheets from now on, and also I think, refusing to sign them at the start of the pay period, incase I don't work there again, as is common practice, rather, making sure I have half a day off at the end of the period to go round schools and check and sign them when I know I won't be working there again!

I also wanted to put in writing how disappointed I am not to get my pay from School Y this month. I worked five days in October which I didn't receive in November as they didn't have all of my details for the timesheets. Now to not get it in December either as they were late submitting the paperwork is really costing me! I live practically hand to mouth, and had assumed I'd got the money back in November, so wrote cheques out for bills/council tax etc. Now I've been charged for 2 months running by my very uninterested bank for being overdrawn! My turkey's losing weight fast and Santa isn't going to get any sherry with his mince pies!

Kind Regards

e very interesting reading and wished me luck fighting the LEA and school, they certainly think I should take it further about 6 hours etc. as it seems I have a case.

Although Capita are an out-sourced agency doing pay

only in this area, it was nice to get a bit of reassurance before I contact the LEA.

Thanks for the link to NASUWT info. Looks like I match criteria in that I usually plan, prepare, mark, do breaks, assemblies etc. Whatever class teacher I'm covering usually does in fact! However, I haven't asked Heads directly for full day's pay (need the work/ money too much to "Rock the boat!") and continue to work at hourly rate, (tho' this has NEVER been agreed/discussed with me!)
Local NASUWT are still looking into it now they have details of when/ where worked and a rough calculation of pay difference.
That thread I started at TES seems to have risen up the pages again, (Thanks for resurrecting!) so don't think the issue is going away.

Part-time workers now have to be treated the same as full-time, and given all the benefits in the correct proportion! If you rock the boat and they cause problems, take them to the employment tribunal! They'll lose! That is a European Directive! Quote that in their face! :)

Just bumping this thread as it's a while since it was bumped, and it seems to be coming an issue again... as more NQTs find out what's going on in their pay packet maybe?
