Smile Help! Setting up as a self employed suppy teacher.

Heya!

I'm currently working as a supply teacher. I've recently been asked by the head teacher of the school I'm currently at for long term cover if I am willing to go back in September in a slightly different role.

It was mentioned it would be useful for both sides if I could register as an independatnt / self employed supply teacher to 'cut out the middle man'. I would get more money, the school would pay less.

The question is - how do I go about doing this??

Any advice gratefully received!

Many Thanks in advance!!

Hi and well done on getting a new role.

The school I work with directly issued me with a 'casual teacher contract' and then did everything they would do for any new member of staff - medical check, new CRB, personal details form... all very straight forward really.

Just be careful that your agency don't get wind of it and decide to be difficult!

When I worked regularly at one school they set me up with a council pay

number and I was paid through the council. It came in very handy with other the schools who asked me to do supply as it just meant filling in a council time sheet and it cost them less. Also they sorted out tax and NI.

Yes, same here - I got a LEA personnel number as part of the contract.

Hiya Jane and Wendy,

I did discuss this option with the head teacher. They prefered the option of setting up on my own. There is another supply teacher who works with this school who does this (who I have not yet manage to find!) the head seems to think this is the way forward.
I really don't want to rock the boat too much - I'm just grateful for the offer of work!

Thanks for the advice - and if all else fails I will persue it.

But for now I really think setting up as an independant supply is the way forward! I just don't know how!!!

A BIG Thanks for your replies!

Hello

I'm just finishing with my school now as a permanent teacher, and am considering setting up a VAT registered Ltd company to do supply as well.

Surely they would accept an up to date CRB, especially if they know you are working at a school at the moment?

Technically, they all need individual ones. I had two contracts last year with schools in the same LEA, in fact, around 200 yards from each other (I know, very handy!) and they both had to have a CRB check done on me!!

Another technically though, they're out of date as soon as they're printed, so I've found a lot of schools aren't bothered if they know of you working at another school...

Well, so far contacted 81 schools (I got a list of about 300 that are within an hour of me). Had a few replies back but have unfortunately been working through an agency, and so have had to turn them down. I set up the Ltd company and went VAT registered, but I haven't been able to put anything through the books as the agency have said it's illegal to work as a teacher (or magician) through your own Ltd company and so will only pay me PAYE?!

This obviously doesn't sound right to me as my accountant would have said, or HMRC when I set up. Anyone know?

Default dont do it!

Hi Dannyboy, Clarabelle etc

As an accountant and supply teacher I have come across a number of supply teachers who seem to be rather proud of the fact that they are operating as a limited company/self employed and saving tax.

I have looked into to this in great detail and would strongly advise against it.

Re claiming mileage/expenses to reduce your taxable income look here:

HMRCdotgovdotuk- EIM70755 in the seach box.

You cannot do it.

Re operating as a limited company (known as an intermediary) and paying dividiends (no nic) instead of salary look here:

HMRCdotgovdotuk/ir35/responsibilitesdothtm

Again - against regs/the law.

The reason you have not been investigated so far is because HMRC do not have the resources. They investigate as and when they can - it could be you

I can point you to other blogs/website etc... just let me know through here.

Being investigated would result in backtax, penalty. Not to mention the stress and cost (you will have to pay an accountant to help provide what HMRC demand of you - attending interviews, providing paperwork etc)

I have had clients in the past who have sufferd high blood pressure etc... Its not pleasant. HMRC are not pleasant to you if they feel you are trying to cheat them.

The accountant/provider etc dont care , they wont tell you this - they are only after a fee. The buck will stop with you as far as HMRC are concerned.

Clarabelle - registering for VAT is of no benefit to you if for teaching - only helps your accountant to bump up fees.- you have to have a turnover of £70k before its compulsory.

My advise - dont do it - be an employee on paye.
